79-1-101 - Titles.

79-1-101(1) This title is known as “Natural Resources.” 79-1-101(2) This chapter is known as “General Provisions.”

79-1-102 - Definitions.

As used in this title: 79-1-102(1) “Department” means the Department of Natural Resources created in Section 79-2-201. 79-1-102(2) “Executive director” means the executive director of the department who is appointed under Section 79-2-202.

79-1-103 - Coordination council.

79-1-103(1) There is created a coordination council that consists of:the executive director of the department;the executive director of the Department of Environmental Quality;the commissioner of the Department of Agriculture and Food;the advisor of the Public Lands Policy Coordinating Office; andthe director of the Office of Energy Development. 79-1-103(2) The coordination council shall:rotate the position of chair among the members; andmeet at least monthly. 79-1-103(3) The coordination council shall discuss methods to enhance the coordination of regulation and services of the five entities.

79-1-104 - Application of title to wildlife issues.

79-1-104(1) The following may not be construed or applied to supersede or interfere with the powers and duties of the Division of Wildlife Resources or the Wildlife Board under Title 23A, Wildlife Resources Act, over the activities described in Subsection (2): Chapter 4, State Parks;Chapter 5, Recreational Trails;Chapter 7, Outdoor Recreation Act; andChapter 8, Outdoor Recreation Grants. 79-1-104(2) Subsection (1) applies to the powers and duties of the Division of Wildlife Resources or the Wildlife Board over:

conservation and management of protected wildlife within the state; a program or initiative to restore and conserve habitat for fish and wildlife; or acquisition, ownership, management, and control of real property or a real property interest, including a leasehold estate, an easement, a right-of-way, or a conservation easement.
