53H-5-101 - General provisions — Definitions.

53H-5-201 - General provisions — Definitions.
As used in this part: 53H-5-201(1) “Advisory board” means the Rocky Mountain Center for Occupational and Environmental Health Advisory Board created in Section 53H-5-203. 53H-5-201(2) “Affected populations” include:employees;employers;insurers;professionals or professional organizations related to occupational and environmental health;government agencies; andoutside academic institutions. 53H-5-201(3) “Center” means the Rocky Mountain Center for Occupational and Environmental Health established in Section 53H-5-202. 53H-5-201(4) “Director” means the director of the center.
53H-5-202 - Rocky Mountain Center for Occupational and Environmental Health.
53H-5-202(1) There is established at the University of Utah and Weber State University the Rocky Mountain Center for Occupational and Environmental Health, to be a center for occupational health, safety, and environment education and research. 53H-5-202(2) The University of Utah and Weber State University shall:jointly operate the center in a manner so that the center is:eligible to be designated as an education and research center by the National Institute for Occupational Safety and Health in the United States Department of Health and Human Services; anda resource for affected populations to:improve workplace health, safety, and environment; andcontribute to economic growth and development in Utah and the surrounding region; andeach appoint a co-principal investigator upon application for the designation described in Subsection (2)(a)(i). 53H-5-202(3) The University of Utah senior vice president for health sciences and the Weber State University provost and vice president of academic affairs shall jointly develop an annual budget for the center that considers funding from all available sources.
53H-5-203 - Advisory board.
53H-5-203(1) In consultation with the director appointed under Section 53H-5-204, the president of the University of Utah and the president of Weber State University, or the presidents’ designees, shall create an advisory board known as the “Rocky Mountain Center for Occupational and Environmental Health Advisory Board” to:promote occupational health and safety in Utah and the surrounding region;promote the development of undergraduate training in occupational health and safety;engage other higher education institutions in the state to participate in improving occupational health and safety education and programs for undergraduate students and other affected populations, including the industrial hygiene program offered at Utah State University;promote the interests and mission of the center by advising the director on issues including:operation of the center as a multidisciplinary, state-of-the-art program at the university;developing and maintaining state and institutional support;emerging local or regional, occupational health and safety education and research needs;continuing education and outreach to local and regional occupational health and safety professionals;coordinating with other local or regional entities that promote occupational health and safety in a manner that meets the needs of both employers and employees; andgrant requirements and renewal;advise the director on the expenditure by the center of public and private funds including:funds appropriated by the Legislature;donations;the proportionate amount of administrative funds available to each university upon the center’s designation as described in Subsection 53H-5-202(2)(a)(i), consistent with federal guidelines; andthe proportionate amount of funds available to each university for the center from public and private grants and contracts; anddevelop recommendations for the long-term operation of the center consistent with Section 53H-5-202. 53H-5-203(2) The advisory board shall consist of no fewer than 15 and no more than 18 individuals who represent the affected populations.In consultation with the director appointed under Section 53H-5-204, the president of the University of Utah and the president of Weber State University, or the presidents’ designees, shall establish reasonable bylaws for the operation of the advisory board including:the selection of advisory board members;quorum requirements; andvoting requirements. 53H-5-203(3) The advisory board shall elect an advisory board chair and vice chair from among the advisory board members by a vote of the members. 53H-5-203(4) The advisory board shall have an executive committee consisting of:the advisory board chair;the advisory board vice chair; andthree other advisory board members, selected by the advisory board chair in consultation with the director.The executive committee shall meet at least quarterly to advise the center and to plan for advisory board meetings. 53H-5-203(5) The advisory board chair, in consultation with the director, shall call advisory board meetings at least two times each calendar year. 53H-5-203(6) The advisory board and the executive committee are subject to Title 52, Chapter 4, Open and Public Meetings Act. 53H-5-203(7) An advisory board member may not receive compensation or benefits for the member’s service, but may receive per diem and travel expenses in accordance with:Section 63A-3-106;Section 63A-3-107; andrules made by the Division of Finance pursuant to Sections 63A-3-106 and 63A-3-107.
53H-5-204 - Appointment and removal of director.
53H-5-204(1) Subject to Subsection (2), the University of Utah senior vice president for health sciences and the Weber State University provost and vice president of academic affairs shall jointly appoint and may jointly remove the director. 53H-5-204(2) The appointment or removal of the director under Subsection (1) may be made only after consultation with:the president of the University of Utah or the president’s designee;the president of Weber State University or the president’s designee;the dean of the University of Utah college of engineering or the dean’s designee; andthe advisory board through the advisory board chair.
53H-5-205 - Reporting requirements.
53H-5-205(1) The advisory board, through the director and the advisory board chair, shall provide by no later than July 1 of each year, a written report to the president of the University of Utah, the president of Weber State University, and the Education Interim Committee. 53H-5-205(2) The report required under Subsection (1) shall:summarize the center’s activities and accomplishments in the immediate proceeding calendar year; andprovide information and the advisory board’s advice and recommendations on how the state, university, and the center can:improve workplace health and safety; andcontribute to economic growth and development in Utah and the surrounding region.
State Arboreta
53H-5-301 - General provisions — Definitions.
53H-5-302 - Establishment of state arboreta — Purpose — Acceptance of gifts.
53H-5-302(1) In recognition of the cultural role that trees and shrubbery and birds and bees have played in the settlement and development of this state and the hardships that many of the pioneers endured to bring to this land seeds, plants, trees, and shrubs which have contributed so much to the scenic beauty of this state, it is deemed expedient that state arboreta be established for the purpose of further developing a knowledge and appreciation of trees and shrubs and to provide a place where the seeds, plants, trees, and shrubs may be planted and cultivated as memorials and for the cultural enjoyment of the people of the state. 53H-5-302(2) State arboreta are created and established at:the University of Utah; andUtah State University.The universities listed in Subsection (2)(a) may:on behalf of the people of this state, cultivate a greater knowledge and public appreciation for the trees and plants around us, as well as those growing in remote sections of the country and world; and receive gifts, contributions, and donations of all kinds, including gifts and contributions of trees, plants, and shrubbery of every variety to promote the purposes and pursuits of an arboretum.
Other Multi-Institution Programs and Initiatives
53H-5-401 - General provisions — Definitions.
53H-5-402 - Multi-University Consortium for Teacher Training in Sensory Impairments — Purposes — Appropriation.
53H-5-402(1) In conjunction with the board’s master plan for higher education, there is established a Multi-University Consortium for Teacher Training in Sensory Impairments which is an outgrowth of a consortium established by the federal government.The consortium shall include within its membership the University of Utah, Utah State University, Brigham Young University, the Utah Schools for the Deaf and the Blind, the Services for At-Risk Students section under the State Board of Education, and local school districts. 53H-5-402(2) The consortium, in collaboration with the board and the State Board of Education, shall develop and implement teacher preparation programs that qualify and certify instructors to work with students who are visually impaired, deaf, or hard of hearing, or both visually impaired and deaf or hard of hearing. 53H-5-402(3) The board shall consider including within the board’s annual budget recommendations a line item appropriation to provide ongoing funding for the programs provided pursuant to this section.
53H-5-403 - Higher Education Engineering Partnership.
53H-5-403(1) Utah State University and Weber State University shall enter into a partnership agreement to jointly deliver a bachelor’s degree in electrical engineering to meet the demand for electrical engineers in the state, including the demand at Hill Air Force Base. 53H-5-403(2) The partnership agreement may provide for:a satellite location for the Utah State University electrical engineering program on a Weber State University campus, including the Davis campus; anda curriculum using courses from:Weber State University’s electrical engineering technology and general education programs; andUtah State University’s electrical engineering bachelor’s degree program and other related programs.
