General Provisions
53H-15-101 - General provisions — Definitions.
As used in this chapter: 53H-15-101(1) “Advisory board” means the Utah Data Research Advisory Board created in Section 53H-15-203. 53H-15-101(2) “Center” means the Utah Data Research Center created in Section 53H-15-202. 53H-15-101(3) “Data” means any information about a person stored in a physical or electronic record. 53H-15-101(4) “Data research program” means the data maintained by the center in accordance with Section 53H-15-302. 53H-15-101(5) “De-identified data” means data about a person that cannot, without additional information, identify the person to another person or machine. 53H-15-101(6) “Director” means the director of the Utah Data Research Center created in Section 53H-15-202. 53H-15-101(7) “Office” means the Office of the Legislative Auditor General created in Section 36-12-15. 53H-15-101(8) “Participating entity” means:the State Board of Education, which includes the director as defined in Section 53E-10-701;the board;the Department of Workforce Services;the Department of Health and Human Services; andthe Department of Commerce. 53H-15-101(9) “Unique student identifier” means the same as that term is defined in Section 53E-4-308.

53H-15-202 - Utah Data Research Center — Creation.
The Utah Data Research Center is created within the Utah system of higher education.
53H-15-203 - Utah Data Research Advisory Board — Composition — Appointment.
53H-15-203(1) There is created the Utah Data Research Advisory Board. 53H-15-203(2) The advisory board is composed of the following members:the state superintendent of the State Board of Education or the state superintendent’s designee;the commissioner or the commissioner’s designee;the executive director of the Department of Workforce Services or the executive director’s designee;the executive director of the Department of Health and Human Services or the executive director’s designee; andthe executive director of the Department of Commerce or the executive director’s designee. 53H-15-203(3) The commissioner or the commissioner’s designee shall serve as chair. 53H-15-203(4) A member of the advisory board:except to the extent a member’s service on the advisory board is related to the member’s duties outside of the advisory board, may not receive compensation or benefits for the member’s service; andmay receive per diem and travel expenses in accordance with:Section 63A-3-106;Section 63A-3-107; andrules made by the Division of Finance under Sections 63A-3-106 and 63A-3-107.
53H-15-204 - Director — Additional staff — Administrative support.
53H-15-204(1) The commissioner shall appoint a director to manage the day-to-day operations of the center. 53H-15-204(2) The director may, with the commissioner’s approval, hire staff, including:data scientists;data technology experts; anddata security experts.

53H-15-301 - General Provisions — Definitions.
53H-15-302 - Data research program.
53H-15-302(1) The center shall establish a data research program for the purpose of analyzing data that is:collected over time;aggregated from multiple sources; andconnected and de-identified. 53H-15-302(2) The center may, in order to establish the data research program described in Subsection (1):acquire property or equipment in order to store aggregated, connected, and de-identified data derived from data contributed by the participating entities; orcontract with a private entity in accordance with Title 63G, Chapter 6a, Utah Procurement Code, or with a state government entity to:store aggregated, connected, and de-identified data derived from data contributed by the participating entities; orutilize existing aggregated, connected, and de-identified data maintained by a state government entity. 53H-15-302(3) A participating entity shall contribute data to the data research program described in Subsection (1) within guidelines established by the center. 53H-15-302(4) The center may only release data maintained by the center in accordance with the procedures described in this chapter. 53H-15-302(5) The center shall:as directed by the board, serve as a repository in the state of data from institutions of higher education;collaborate with the board and the State Board of Education to coordinate access to the unique student identifier of a public education student who later attends an institution of higher education in accordance with Sections 53H-1-207 and 53E-4-308;develop, establish, and maintain programs that promote access to data from institutions of higher education;identify initiatives that leverage education data that will improve a state citizen’s ability to:access services at an institution of higher education; orgraduate with a postsecondary certificate or degree; andperform all other duties provided in this chapter. 53H-15-302(6) The director shall identify the resources necessary to successfully implement initiatives described in Subsection (5)(d), in accordance with Section 53H-8-202. 53H-15-302(7) The center may:employ staff necessary to carry out the center’s duties;purchase, own, create, or maintain equipment necessary to:collect data from the participating entities;connect and de-identify data collected by the center;store connected and de-identified data; orconduct research on data stored or obtained by the center; orcontract with a private entity, another state or federal entity, or a political subdivision of the state to carry out the center’s duties as provided in this chapter. 53H-15-302(8) The data research program is not subject to Title 63G, Chapter 2, Government Records Access and Management Act. 53H-15-302(9) The center:shall, in connection with the office’s audit of an entity, provide the office, at the office’s request, with access to all records, data, and other materials in possession of the center; andis otherwise subject to the authority of the legislative auditor general in accordance with Utah Constitution, Article VI, Section 33, and Section 36-12-15.The office’s request for access to records, data, and other materials under Subsection (9)(a)(i) is not:a data research request under Subsection 53H-15-303(3)(a) or (4); ora request for a data set under Subsection 53H-15-303(10).The center, in complying with Subsection (9)(a)(i):shall, upon the office’s request, provide the office with records, data, and other materials that are not de-identified; andmay not charge the office a fee for completing the request.
53H-15-303 - Data research requests.
53H-15-303(1) The center shall use data that the center maintains or that a participating entity contributes to the data research program under Section 53H-15-302 to conduct research for the purpose of developing public policy for the state. 53H-15-303(2) The director, with consultation by the advisory board, shall create a prioritized list of data research for the center to conduct using the data research program each year. 53H-15-303(3) In developing the list described in Subsection (2), the center shall accept data research requests from:a legislative committee or a legislative staff office;the governor or an executive branch agency;the State Board of Education; andthe board.The center shall report the list described in Subsection (2) to the Education Interim Committee before December 1 of each year. 53H-15-303(4) In addition to conducting data research in accordance with the prioritized list described in Subsection (2), the center may use additional resources to prepare data research at the request of:a state government entity;a political subdivision of the state;a private entity; ora member of the public. 53H-15-303(5) The director, with approval by the advisory board, shall determine, for a data research request described in Subsection (4):whether the center has the resources to complete the data research request;the order in which the center shall complete the data research request, if at all; anda reasonable estimated cost for the request. 53H-15-303(6) The center, after evaluating a request under Subsection (5), shall:provide the person that requested the data research with a cost estimate; andrequire, before accepting a data research request, that the person that submitted the data research request agree to pay, once the data research is complete, the full cost of completing the data research request as determined by the center under Subsection (5). 53H-15-303(7) The center shall make available to the public, on a website maintained by the center, any data research request that the center completes under this section. 53H-15-303(8) The center shall ensure that any data contained in a completed data research request is de-identified. 53H-15-303(9) The center shall:establish, by rule made in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act:procedures for submitting a data research request under this section;criteria to determine how to prioritize data research requests; andminimum standards for information a person is required to include in a data research request; andcreate a fee schedule in accordance with Section 63J-1-504 for completing a data research request. 53H-15-303(10) In addition to submitting a data research request under Subsection (4), a participating entity, executive branch agency, or legislative staff office may request, and the center may release, a data set from the data research program if the data set is:connected;aggregated; andde-identified. 53H-15-303(11) The center shall use any fee the center collects under this section to cover the center’s costs to administer this chapter.The center shall deposit any fee the center collects under this section not used to cover the center’s costs into the General Fund.
53H-15-304 - Data visualization access.
53H-15-304(1) In addition to performing data research and responding to data research requests under Section 53H-15-303, the center shall create an online data visualization portal that provides access to the public to connected, aggregated, and de-identified data in the program. 53H-15-304(2) The data visualization portal described in Subsection (1) shall include role-based dashboards that:allow a user to query data in the program;integrate real-time data; andallow a user to view queried data in a customizable environment.
53H-15-305 - Reporting.
53H-15-305(1) The center shall report to the Education Interim Committee and Business and Labor Interim Committee:before July 1 of each year regarding the center’s:research and services priorities for the year;completed research from the previous year; andactivities and accomplishments in the previous year; andbefore December 1 of each year, the center’s ongoing data research and services priority list described in Subsection 53H-15-303(2). 53H-15-305(2) The Education Interim Committee shall provide the center ongoing input regarding the center’s activities and data research priorities.
